PLEASE READ THESE TERMS CAREFULLY BEFORE USING THIS WEBSITE OR PURCHASING OUR SERVICE. BY PLACING AN ORDER YOU CONFIRM THAT YOU HAVE READ, UNDERSTOOD AND ACCEPTED THESE TERMS.
1. ABOUT THESE TERMS AND ABOUT US
1.1 These Terms of Service (the "Terms") govern your access to and use of maldives-traveller-declaration.com (the "Website") and any services purchased through it (the "Service").
1.2 The Website is operated by Global Entry Form LLC, registered in the United States (State of New Mexico) under number 0008098270, registered office 1209 Mountain Road Pl NE, Ste N, Albuquerque, NM 87110, United States ("we", "us", "our").
1.3 In these Terms: "you" or "Customer" means the person placing an order; "Applicant" means the traveller the Maldives TD relates to (which may be you or a person you are authorised to act for); "Authority" means Maldives Immigration or any other competent public body.
1.4 These Terms, together with the Privacy Policy, the Cookie Policy and the Refund and Cancellation Policy, form the entire agreement between you and us.
2. INDEPENDENT SERVICE — NO GOVERNMENT AFFILIATION
2.1 THIS IS NOT A GOVERNMENT WEBSITE. We are a private commercial company. We are not operated by, affiliated with, associated with, authorised by, endorsed by, licensed by, sponsored by or in any way officially connected to Maldives Immigration, the government of the Maldives, any embassy, consulate, ministry, border agency or any other public authority of any country.
2.2 You can apply for, complete and submit the Maldives TD yourself, directly and without any intermediary, on the official government website at https://imuga.immigration.gov.mv. Where the official government charge for the Maldives TD is zero, the Maldives TD is free of charge if you do it yourself.
2.3 The amount you pay us is a SERVICE FEE for the optional assistance described in clause 3. It is not a government fee, tax, levy or duty, and it is not paid to or shared with any government. Where the Authority also charges a fee, that amount is separate and is identified as such at checkout.
2.4 We do not issue, approve, grant, refuse, expedite or influence any declaration, authorisation, permit or visa. All decisions are made exclusively by the competent Authority, applying its own criteria and timelines.
2.5 Any government name, logo, emblem or trade mark referred to on the Website is used solely for descriptive and identification purposes and does not imply any relationship, endorsement or approval.
3. WHAT THE SERVICE INCLUDES
3.1 Depending on the product you select, the Service may include: (a) a guided, simplified online form to collect the information required by the Authority; (b) a human and/or automated review of the information supplied for completeness, internal consistency and obvious errors, including a check of names and document numbers against the details you provide; (c) informational guidance on the requirements applicable to your trip; (d) preparation and submission of the Maldives TD to the Authority on your behalf, within the applicable submission window; (e) notification of the outcome received from the Authority; (f) customer support before, during and immediately after submission.
3.2 The Service EXPRESSLY EXCLUDES: (a) any guarantee that the Authority will accept, approve or process your Maldives TD; (b) legal, immigration, tax or financial advice; (c) representation before any authority, court or tribunal; (d) any guarantee that you will be permitted to board a carrier or to enter the Maldives, which remains at the sole discretion of carriers and border officers; (e) travel arrangements, insurance, accommodation or any other travel product.
3.3 We may perform the Service using our own staff, automated systems, or carefully selected subcontractors. We remain responsible to you for the Service.
4. ELIGIBILITY
4.1 You must be at least 18 years old and legally capable of entering into a binding contract.
4.2 If you place an order on behalf of another person (including a minor, a family member, an employee or a client), you represent and warrant that you have that person's authority (or, for a minor, the authority of a parent or legal guardian) to provide their personal data to us and to instruct us on their behalf, and that you have made them aware of these Terms and our Privacy Policy.
5. ORDERS AND FORMATION OF CONTRACT
5.1 Your order is an offer to purchase the Service. The contract is formed when we send you an order confirmation by email.
5.2 We may refuse or cancel any order, at our discretion and with a full refund, including where we suspect fraud, where the information supplied is manifestly false or unlawful, where the Service cannot lawfully be provided to you, or where a pricing or technical error has occurred.
5.3 We will provide confirmation of the contract on a durable medium (email), including these Terms.
6. FEES AND PAYMENT
6.1 The total price payable, including any applicable taxes and any separate government charge, is displayed before you confirm your order.
6.2 Our service fee is the amount displayed at checkout before you confirm your order. Prices may change at any time, but changes do not affect orders already confirmed.
6.3 PAYMENT PROCESSING AND CARD DATA. All card payments are processed by our third-party payment service provider TailoredPay (https://tailoredpay.com) and/or its acquiring banks. Card details are entered into a payment environment operated by TailoredPay and are transmitted directly to it. WE DO NOT COLLECT, PROCESS, TRANSMIT, VIEW OR STORE YOUR FULL CARD NUMBER, CVV/CVC SECURITY CODE, PIN, OR ANY OTHER FULL PAYMENT CARD DATA AT ANY TIME, ON ANY SYSTEM OF OURS. We receive only a transaction result and limited non-sensitive metadata (such as an authorisation reference, the last four digits of the card, the card scheme, the amount and the status). Your card data is handled by TailoredPay under its own terms and privacy policy and under the Payment Card Industry Data Security Standard (PCI DSS).
6.4 If a payment is reversed, charged back or fails after the Service has been delivered, we reserve the right to recover the amount due, including reasonable recovery costs.
7. YOUR OBLIGATIONS — ACCURACY OF INFORMATION
7.1 You are solely responsible for the accuracy, completeness, truthfulness and timeliness of all information and documents you provide, including names exactly as written in the travel document, document numbers, dates, nationality, travel dates, flight details, addresses and any declaration answers.
7.2 We check the information you give us for internal consistency and obvious errors. WE CANNOT VERIFY THE TRUTH OF THAT INFORMATION and we do not have access to any government database.
7.3 Declarations to a public authority are made in your name and under your responsibility. Providing false, incomplete or misleading information to an authority may constitute an offence and may result in fines, refusal of entry, seizure of goods, detention or removal. WE ACCEPT NO LIABILITY FOR CONSEQUENCES ARISING FROM INFORMATION YOU SUPPLIED THAT WAS INCORRECT, INCOMPLETE, OUTDATED OR UNTRUE.
7.4 You must inform us immediately of any error in your submitted information. Because we delete your data shortly after the Service is completed (see the Privacy Policy), corrections after that point will require you to submit the information again.
7.5 You are responsible for holding a valid travel document, for meeting all entry, health, customs and biosecurity requirements, and for checking the official sources before you travel.
8. TIMEFRAMES AND OUTCOMES — NO GUARANTEE
8.1 Any processing time we mention is an estimate based on ordinary conditions. Actual times are determined by the Authority and are outside our control.
8.2 We do not guarantee any particular outcome. Approval, refusal, delay, suspension, request for further information and revocation are decisions of the Authority alone.
8.3 You are strongly advised not to make non-refundable travel arrangements that depend on obtaining the Maldives TD until it has actually been granted.
8.4 Some documents may only be submitted within a defined window before travel. If you place an order outside that window, submission will take place when the window opens; it is your responsibility to order in sufficient time.
9. RIGHT OF WITHDRAWAL (CONSUMERS IN THE EU/EEA AND UK)
9.1 If you are a consumer resident in the EU/EEA or the United Kingdom, you normally have 14 days from the conclusion of the contract to withdraw without giving a reason.
9.2 BECAUSE THIS SERVICE IS TIME-CRITICAL, we begin performance immediately. Before payment you are asked to tick a box with the following statement: "I request that Maldives Traveller Declaration begins providing the service immediately, and I acknowledge that once the service has been fully performed I will lose my right of withdrawal."
9.3 If you tick that box and we then fully perform the Service, your right of withdrawal is lost, in accordance with Article 16(a) of Directive 2011/83/EU and equivalent national law.
9.4 If you withdraw after performance has begun but before it is complete, you must pay an amount proportionate to what has been provided up to that point.
9.5 If you do not tick the box, performance will not begin until the 14-day period has expired or you instruct us otherwise, which may mean we cannot meet your travel date.
9.6 Model withdrawal notice: send to info@globalentryform.com stating your order reference, your name, the date of the order, and that you withdraw from the contract.
10. CANCELLATION AND REFUNDS
Cancellations and refunds are governed by our Refund and Cancellation Policy, which forms part of these Terms and does not affect your statutory rights.
11. ACCEPTABLE USE AND PROHIBITED CONDUCT
11.1 You must not use the Website or the Service to: (a) submit false, fraudulent, stolen or another person's data without authority; (b) commit or facilitate any offence, including immigration fraud, identity fraud, money laundering, smuggling or trafficking; (c) circumvent, disrupt, overload, probe or reverse engineer the Website or its security; (d) scrape, harvest, mirror or systematically extract content; (e) resell, sublicense or commercially exploit the Service without our prior written consent; (f) impersonate any person or any public authority.
11.2 We may suspend or terminate access immediately for breach of this clause, and may report suspected offences to the competent authorities.
12. INTELLECTUAL PROPERTY
12.1 All content on the Website — text, guides, layout, graphics, software, and the Maldives Traveller Declaration name and logo — is owned by us or licensed to us and is protected by intellectual property law.
12.2 You may view and print content for your own personal, non-commercial use. All other use requires our prior written permission.
12.3 You grant us a limited licence to use the data and documents you supply solely to provide the Service.
13. THIRD-PARTY WEBSITES AND CONTENT
We link to third-party websites, including official government sites, for convenience. We do not control them, do not endorse them and are not responsible for their content, availability, accuracy or privacy practices.
14. DISCLAIMER OF WARRANTIES
14.1 Informational content on the Website is provided for general guidance only. Entry, customs and biosecurity requirements change frequently and vary by nationality, route and personal circumstances. Always confirm requirements with the official sources of the Maldives and with your carrier.
14.2 To the fullest extent permitted by law, and except as expressly stated in these Terms, the Website and the Service are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.
14.3 We do not warrant that the Website will be uninterrupted, error-free or free of harmful components.
14.4 Nothing in this clause excludes rights that cannot lawfully be excluded, including consumer guarantees under applicable consumer protection law.
15. LIMITATION OF LIABILITY
15.1 Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited.
15.2 Subject to clause 15.1, and to the fullest extent permitted by law, we are not liable for: (a) refusal, delay, revocation or any other decision of any Authority, carrier or border officer; (b) refusal of boarding, denial of entry, deportation, fines, penalties or confiscation; (c) missed flights, missed connections, cancelled or rearranged travel, accommodation costs or loss of enjoyment; (d) any loss arising from information you supplied that was inaccurate, incomplete or untrue; (e) changes to law, policy or procedure by any Authority; (f) failures of third-party systems, including government portals and payment providers; (g) indirect, consequential, special or punitive loss, loss of profit, revenue, business, data or goodwill.
15.3 Subject to clause 15.1, our total aggregate liability arising out of or in connection with the Service is limited to the total amount of the service fee you actually paid us for the order concerned.
15.4 If you are a consumer, this clause applies only to the extent permitted by the mandatory consumer law of your country of residence.
16. INDEMNITY
If you are not acting as a consumer, you agree to indemnify us against all claims, losses, penalties and reasonable costs arising from your breach of these Terms, from information you supplied, or from your unlawful use of the Service.
17. FORCE MAJEURE
We are not liable for any failure or delay caused by events beyond our reasonable control, including government action, closure or malfunction of official portals, natural disaster, epidemic, war, civil unrest, strikes, cyber-attack, or failure of telecommunications, hosting or payment infrastructure.
18. SUSPENSION, TERMINATION AND AVAILABILITY
18.1 We may modify, suspend or discontinue the Website or any part of the Service at any time.
18.2 We may terminate your access immediately if you breach these Terms.
18.3 Clauses that by their nature should survive termination (including 12, 14, 15, 16 and 21) survive.
19. CHANGES TO THESE TERMS
We may amend these Terms at any time by publishing the amended version on the Website with an updated revision date. The version in force at the time of your order governs that order.
20. COMPLAINTS AND DISPUTE RESOLUTION
20.1 Please contact us first at info@globalentryform.com. We aim to acknowledge within 2 business days and to resolve within 14 days.
20.2 EU consumers may also use the European Commission's online dispute resolution facilities where available, and may contact the consumer protection authority or the European Consumer Centre in their country of residence.
21. GOVERNING LAW AND JURISDICTION
21.1 These Terms are governed by the laws of the State of New Mexico, United States.
21.2 The courts of Bernalillo County, New Mexico have jurisdiction.
21.3 If you are a consumer, this does not deprive you of the protection of the mandatory provisions of the law of your country of habitual residence, and you may also bring proceedings in the courts of that country.
22. GENERAL
22.1 If any provision is held invalid, the remainder continues in force.
22.2 Our failure to enforce a provision is not a waiver of it.
22.3 We may assign or transfer these Terms in connection with a merger, acquisition or sale of assets. You may not assign without our written consent.
22.4 No third party has any right to enforce these Terms.
22.5 These Terms may be published in several languages. If there is a conflict, the English version prevails, except where mandatory consumer law provides otherwise.
